CGPDTM Published Draft of Manual of Trademark Practice and Procedure
On March 11, 2015, the CGPDTM (Controller General of Patents, Designs and Trademarks) has published the Draft of Manual of Trademark Practice and Procedure (hereinafter referred to as the Manual). According to the CGPDTM, the Manual has been published with the objective to bring uniformity in the practice and prosecution of trademark applications in India.
The Manual brings together the provisions of the Trade Marks Act, 1999, corresponding Trade Marks Rules alongwith the office practice followed in examination and prosecution of trademark applications. The Manual in order to simplify the procedural aspects of trademark prosecution divides the trademark issues into three parts, namely- underlying concepts, requirements from the stakeholder and the required office action according to the Trademark Act and Rules.
According to the CGPDTM, the Manual also reflects the changing practices in view of technological advancements and their implementation by the Trademark Office.
