Accountability of Celebrities endorsing food products

The law relating to food and corresponding regulations has been in the limelight in India owing to the famous Nestle Maggi Noodles controversy, wherein the FSSAI vide its order dated June 05, 2015 directed Nestle India to withdraw and recall 9 approved variants of its Maggi Noodles from market on account of being found unsafe and hazardous for human consumption and stop further production, processing, import, distribution and sale of the said product with immediate effect. Reportedly, the celebrities who had advertised Maggi Noodles namely, Amitabh Bachchan, Madhuri Dixit and Preity Zinta had also been served with notices from the Court.

The outcome of the case will decide the accountability of celebrities while advertising a product. Recently, the CCPC (Central Consumer Protection Council), the body governing consumer protection in India has also decided to hold actors accountable in cases of false claims made in advertisements for products which they endorse if they have made a statement “recklessly” or with the knowledge that the claim was false or misleading.
