Establishment of a mechanism for registration of documents at the Sub- registrar Office

The Indian Daily, Economic Times has reported that the Hon’ble Delhi High Court has issued notice to the Centre while responding to a PIL (Public Interest Litigation), seeking establishment of a system for e-registration of all documents at the Sub-registrar’s Office[1].

The PIL has been filed by one, DC Tuteja with the objective to avoid physical presence and gathering at the Sub-registrar’s Office in the wake of COVID-19 outbreak. As the pandemic has been witnessing a spike in the territory of Delhi, social distancing and avoiding rush and formation of queue at public offices will certainly mitigate the transmission of the deadly virus.

The Petition also urges that efforts should also be made to devise mechanism for virtual registration of secret documents like Wills.

In view of the plea made in the Petition, the Hon’ble Division Bench of the Delhi High Court headed by Chief Justice D.N. Patel and Justice Prateek Jalan have issued notice to the Centre and the Delhi Government in the matter.

The matter is next scheduled to be taken up on July 23, 2020.

The spread of the virus has compelled the Indian Judiciary and Government Authorities to devise mechanisms which would dispense the requirement of physical presence at the Courts and Government Offices. Recently, the Delhi High Court had also permitted the E-service of Summons and Documents  and also allowed Public Viewing of Court proceedings. Thus, the establishment system for e-registration of documents at the Sub- registrar Office would also be a major step towards mitigating the impact of virus.

The measures taken by the Courts have been commendable and aid in swiftly streamlining the practice of Virtual Courts and Virtual Hearings in India- the new normal!!
