Increase in Trade Mark application fees

The Controller General of Patents, Designs and Trade Marks (CGPDTM) has issued a public notice informing the general public that the official fee for the following purposes have been increased with effect from August 1, 2014:

  • An application to register a trade mark in one class has been increased from INR 3,500 to INR 4,000
  • Application to expedite examination of a mark has been increased to INR 20,000.

According to the said notice, the aforesaid increase has been done in consequence of notification issued by the Ministry of Commerce and Industry dated August 01, 2014.

TThe CGPDTM has further informed that as the notice is effective from August 1, 2014 all applicants/agents who have filed applications for registering a mark or expediting examination of the mark from August 01 to August 07 have to deposit the balance amount to the Registry by September 30, 2014. The balance fee is as under:

  • INR 500 for per trade mark application in one class
  • INR 2500 for per request to expedite examination

The notice further entails that receipt in deficiency of fees after September 30, 2014 shall result in shifting of actual date of filing the application to the date of payment of deficiency in fees.
