India: Delhi High Court imposes ban on online sales of medicines

As per news reports, in an order dated December 12th 2018 in the case of Dr. Zaheer Ahmed v. The Union of India & Ors. (W.P.(C) 11711/2018), a Division Bench of the Delhi High Court consisting of Chief Justice Rajendra Menon and Justice V. Kameswar Rao imposed a ban on pan-India sales of medicines through online portals. The order was passed in a Writ Petition filed by Dr. Zaheer Ahmad ÔÇô a Delhi based dermatologist.

News reports indicate that Dr. Ahmed had inter alia contended in his petition that these so-called e-pharmacy portal were openly flouting provisions of the Drugs and Cosmetics Act, 1940 and the Pharmacy Act, 1948 by operating without seeking any registration and were exposing the public to substandard pharmaceutical products.
