Public Notice on International Registration of Trademarks

The Intellectual Property Office (IPO) has notified that the statutory provisions with reference to International Registration of Trademarks under the Madrid Protocol has come into force in India from July 08, 2013, and accordingly the amendments in the Trade Marks Act and Rules enabling the International Registration under Madrid Protocol has also become effective from the said date.

The Notice further states that any natural person or legal entity possessing a real and effective industrial or commercial establishment in India or domiciled in India or is a national of India and has registration of a trademark or pending application for a mark can make an online application for International Registration of Trademark under the Protocol. The IPO has also provided a gateway for filing an application online under the Madrid Protocol at the home page of the IPO website and has also delineated the pre-requisites and other necessary instructions for filing applications at www.ipindia.nic.in.
