What is the criteria for patentability in Japan?

The basic criteria for patentability are:    

  • novelty;
  • inventive step; and
  • industrial applicability.

As per Article 2(1) of the Japan Patent Act, an ‘invention’ is defined as “the highly advanced creation of technical ideas by which a law of nature is utilized”
