India: Trademarks Registry gives opportunity to all applicants to complete documentation in their application

February 13, 2017, New Delhi

The Office of the Controller General of Patents, Designs and Trademarks (hereinafter referred to as the ‘CGPDTM’) has over time reduced the Pendency in Examination of applications filed for the registration of a trademark to less than a month, by virtue of which applications filed in January 2017 are already in the process of examination. However, the Registry has identified a list of applications that were filed before December 2016, and were not taken up for examination because of lack of complete documentation.

It should be noted that the applications are categorized into two groups –

  • Group I: Due to incomplete digitization.
  • Group II: Due to formality check fail during examination and non-compliance with office direction.

Through a notice dated February 13, 2017, the Controller has directed all applicants or their agents whose application is falling in Group I to email the brief details of the application at pendingexam.tmr@nic.in, and those that are falling in Group II to take notice of non-compliance and resolve the same at the earliest.
