In India a Patent application is not examined automatically. A Patent is examined only on filing request for examination. The Indian Patent Act, 1970 under Section 11B provides for filing request for examination with the Indian Patent Office. It states that no application will be examined unless the interested person makes a request for examination of patent application in the prescribed manner within the prescribed period. Hence, its crucial that the statutory time line to file request for examination is followed.
When can the request for Patent examination be in India?
The request for examination for a patent application in India can be filed within a period of 48 months from the date of priority or date of filing of the application whichever is earlier.

EARLY PUBLICATION OF PATENT APPLICATION IN INDIA
The Indian Patent Law provides for filing a request with the Indian Patent Office for early publication of Patent application. The request for early publication of application is made on Form 9 along with the prescribed fee.
Request for early publication of Patent application can be filed by the applicant only. On receiving request for early publication, the Indian Patent Office shall publish the application within one month. However, the application shall not relate to Atomic Energy or Defense purpose.
