On August 19, 2025, the Department of Industries, Nepal had published a notice concerning trademark registration and maintenance under the Patent, Design and Trademark Act, 1965. However, due to the Gen-Z protests and destruction of physical files, the DoI suspended the earlier public notice via a new notice dated September 24, 2025.
The DoI has now issued another notice dated December 01, 2025 concerning the pending trademark applications. A copy of the notice along with its English translation is attached herewith for your reference.
As per the notice, trademark applicants are required to take the following actions within the stipulated timelines:
- Applications pending publication– All previous applicants who had submitted trademark application but had not completed their necessary documentation must re-submit the application along with necessary documents to the Department within 90 days from the notice date, i.e., on or before February 28, 2026.
Any applications pending for more than seven years that are not resubmitted within this 90 day window will be automatically cancelled after the deadline. - Applications Pending Registration– All applicants, whose trademark applications were published in the Industrial Property Bulletin and successfully passed the opposition period without any third party objection, must submit an application to the DoI with necessary documents to obtain the registration certificate. This application must be submitted within 6 months i.e. on or before May 31, 2026.
Failure to act within this period will result in cancellation of application.
In light of the above, we kindly request you to review your trademark portfolio in Nepal and inform us at the earliest if any of your applications fall under the categories mentioned above.
If so, we strongly recommend initiating the necessary actions without delay to avoid any adverse consequences, including abandonment or rejection of your trademark rights in Nepal.
