Understanding Law related to Patents in Maldives
A patent is an exclusive right granted for an invention, which may be a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem. To get a patent, technical information about the invention must be disclosed to the public in a patent application.
Maldives does not have any specific Patent law or Intellectual Property Office therefore Patent Protection is by way of Common law. The said protection is sought by publication of cautionary notice in a leading Newspaper in Maldives, under common laws of “passing off”. This serves as a notice to public that said invention belongs to someone and if required, a passing off remedy shall be exercised in a court.
