Panel discussion on ‘the eternal problem of grey market and parallel imported goods’

Ltd. Nihit Nagpal was a panelist for discussion on “Addressing the eternal problem of grey market and parallel imported goods”. Nihit Nagpal highlighted the nuances of law and interpretation of landmark Judgment in the case of Kapil Wadhwa & Ors. vs Samsung Electronics Co. Ltd., wherein a safe harbour was given to the parallel import based on the doctrine of International Exhaustion. Nihit Nagpal in his discussion emphasized that the need of the hour was to formulate rules or legislation that strikes a balance between doctrine of exhaustion and reasonable restrictions on the same.
Nihit Nagpal was also chosen as the Leader at the round table discussion to enlist most effective remedies against infringement of Trademarks, wherein Mr. Nagpal highlighted various non-traditional and non- IP actions in addition to civil and criminal raids, such as pre-litigation mediation, rectification of corporate name, domain name arbitration, custom recordal etc.
