New Delhi April 5, 2016 In our earlier Newsletter and India IP News Alert dated February 22, 2016, we had reported that the Office of the Controller General of Patents, Designs and Trademarks (CGPDTM), India, had released a Public Notice on February 19, 2016, stating that it has, in collaboration with the Delhi State Legal Service Authority (DSLSA), undertaken to initiate a process of Mediation and Conciliation in contested matters of the Trade Marks Registry, New Delhi. In view of the pendency of Opposition/Rectification matters at Trade Mark Registry (TMR), Delhi. It was initially decided to undertake the project on pilot basis by taking up only 500 pending Opposition and Rectification matters.

In an update to the above, the CGPDTM has now released a Public Notice dated March 31, 2016, stating that the Office has now decided to invite consent from the concerned parties in all the Opposition/Rectification proceedings pending in the TMR, Delhi, and where the final hearing has not been concluded. The interested parties in the aforesaid Opposition/Rectification proceedings may submit their consent in the ‘Consent Form’ to the TMR, Delhi, within 30 days from the date of notice so that their matters may be referred to the DSLSA for further action.
