How to register a trademark in Myanmar

Trademarks are registered in Myanmar under section 18(f) of the Registration Act of 1999 by means of declaration which a solemn statement of facts made by trademark owner. It is also advisable to publish a trademark cautionary notice in leading local newspaper thereby cautioning the public about the ownership of the trademark.

Requirements for Filing a Trademark Application in Myanmar: Who Can File a Trademark Application in Myanmar?

Any person who claims to be the proprietor of the trademark can register its trademark by filing Declaration of Ownership of the Trademark. The Declaration of Ownership of Trademark is required to be filed with the Registration of Deeds Office, Yangon. After registration of Declaration of Ownership of Trademark with the Registration of Deeds Office, Yangon, it is advisable to publish trademark cautionary notice in local newspaper of Myanmar cautioning the public about the ownership of the mark.

Duration of registration:

In the absence of trademark law in Myanmar, there is no statutory term for which a trademark is registered. However, the common practice in Nepal is to re-register the Declaration of Ownership of Trademark with Registry of Deeds, Yangon and thereafter publication of trademark cautionary notice after every 3 years.

Registration Procedure:

The procedure for registration of a Trademark in Myanmar is as follows:

  1. Registration a Trademark in Myanmar– A Declaration of Ownership of Trademark can be filed with the Registry of Deeds, Yangon.
  2. Official Examination of a Trademark in Myanmar/ Issuance of Office Action– In the absence of trademark law in Myanmar, a trademark is not official examined.
  3. Publication / Advertisement of a Trademark – In the absence of a trademark law in Myanmar, there is no provision for publication of a mark in Trademarks Journal.
  4. Opposition of Published Trademark – In the absence of a trademark law in Myanmar, there is no provision for initiating opposition proceedings against a similar trademark.
  5. Publication of Trademark Cautionary Notice– In the absence of trademark law in Myanmar, registration of a mark is necessitated by registration of Declaration of Ownership of Trademark and subsequent publication of Trademark Cautionary Notice in local newspaper of Myanmar cautioning the general public and trade about the ownership of the trademark.
