Application for Geographical Indication Rectification
Section 27 of the Geographical Indication of Goods (Registration and Protection) Act, 1999 (hereinafter referred to as the “Act”) provides for the . Power of the Registrar to Cancel or Vary Registration and to Rectify the Register.
- An application for geographical indication rectification is made in the prescribed manner to the Appellate Board or to the Registrar by the aggrieved person. Thereafter, the tribunal may make an order if it thinks fit for cancelling or varying the GI registration.
- An application for rectification of GI can be filed on the ground of any contravention, or failure to observe the condition entered on the register in relation to the GI.
- An order of the Appellate Board to rectify the register shall direct that the Registrar shall on receipt of notice of rectification shall in the prescribed manner rectify the register.
- The request for removal of geographical indication is made on Form GI-6 and the same can be accessed here.
Appeals
An appeal to the Intellectual Property Appellate Board (IPAB) from any decision of the Registrar under the Act or the rules shall be made within three months from the date of receipt of such decision or within such further time as the said Appellate Board may allow.
