Patent prosecution in India
Patent prosecution covers the steps between filing a patent application and its grant. In India it is governed by the Patents Act, 1970 and the Patents Rules, 2003, before the Office of the Controller General of Patents, Designs and Trade Marks, which has patent offices in Kolkata, Delhi, Mumbai and Chennai. The work includes drafting specifications, filing requests for examination, replying to First Examination Reports, attending hearings before the Controller and handling pre-grant oppositions.
In chemistry, life sciences and pharmaceuticals, prosecution in India raises particular questions, including the limits on patenting new forms of known substances under Section 3(d) of the Patents Act and the exclusion of certain methods of treatment, so technical depth in these fields shapes how claims are drafted and defended.
