Patent Assignment in India refers to the transfer of ownership rights in a patent or a part-interest in a patent from one party to another. Although the term “patent assignment” is not expressly defined in the Indian Patent Act, 1970, the Act and Rules mandate that any assignment — whether transferring full ownership, a share, mortgage, or other interests — must be effected through a written deed executed between the parties. The deed of assignment must clearly set out the rights and obligations of the assignor and assignee and be documented properly for legal validity.

Once executed, the deed of assignment and supporting evidence of title must be registered with the Indian Patent Office by filing Form-16 with the Controller General of Patents, Designs and Trademarks (CGPDTM). Upon satisfactory proof of title, the Controller will record the assignment in the Patent Register.

  1. Form-16 Submission

An application in Form-16 is filed with the Indian Patent Office to record the assignment or transfer of patent rights.

  1. Deed of Assignment

A properly drafted deed of assignment executed by the assignor and assignee must accompany the application.

  1. Title Evidence

Documents evidencing transfer, sale, assignment, or any change affecting patent proprietary rights should be enclosed.

  1. Copies of Assignment Deed

Two copies of the signed assignment deed are typically submitted along with Form-16.
