Requirements for non-provisional patent application filing in India:

The application has to be filed in accordance with Section 10 of the Indian Patents Act, 1970 along-with the following formal documents-

  1. Power of authority in Form 26 is required if the patent application is filed through a Patent Agent. The deadline to file Form 26 is 3 months from the date of filing in India.
  2. Declaration as to inventorship on Form 5 is required to be filed.
  3. An executed proof of right (Form 1/Assignment agreement/Declaration under Article 4.17(ii) of the PCT regulations) to be filed within 6 months from the date of application.
  4. An applicant must file Form 3 either along with the application or within 6 months from the date of application.
