How and when can a PCT International Patent Application can be filed from India?
PCT International Patent Application along with request form should be accompanied with description; one or more claims, one or more drawings (if any),sequence listing (if any), an abstract and the required fee. The application has to be filed in English language PCT International Patent Application has to be filed within 12 months from the date of filing in India. However, if the international filing is within 6 weeks from the date of filing in India, such filing shall be made after taking permission u/s 39 from the Indian Patent Office.
Competent International Searching Authority:
With effect from October 15, 2013, India Patent Office has started functioning as International Search Authority (ISA) and International Preliminary Examining Authority under the PCT.

Austrian Patent Office (AU),
European Patent Office (EPO),
Indian Patent Office (IPO) (w.e.f October 15th, 2013)
