Filing trademarks abroad from India: the Madrid route
For Indian brands expanding overseas, the Madrid Protocol is often the most efficient way to seek protection in several countries at once.
One application, many countries. India has been a member of the Madrid Protocol since July 2013. An Indian applicant can file a single international application through the Indian Trade Marks Registry and designate other member countries, paying fees to WIPO in one currency.
The base mark. The international application must be based on an Indian application or registration for the same mark and the same or narrower goods and services.
Central attack. For five years from the international registration date, the international registration depends on the Indian base mark. If the base mark is refused, withdrawn or cancelled in that period, the international registration falls with it, though it can be converted into national applications.
When to file nationally. Some important markets are outside the Madrid System, and in others local practice makes a national filing more practical, so many portfolios combine Madrid designations with direct national filings.
