A complainant must show that the domain is identical or confusingly similar to its mark, that the registrant has no legitimate interest in it, and that it was registered or is being used in bad faith. An arbitrator can order transfer or cancellation, usually far faster than a court.
Why watch matters: Monitoring the Trade Marks Journal and online channels lets brand owners oppose conflicting applications within the four-month opposition period and act against cybersquatters before they gain traction.
Lucy is herself an arbitrator appointed by NIXI and has decided numerous .in and .co.in domain name complaints under the INDRP.

Lucy Rana is a Managing Partner of S.S. Rana & Co., a full-service IP and corporate law firm founded in 1989 and headquartered in New Delhi.
