Patent oppositions in India
India allows a patent to be challenged both before and after grant, which makes oppositions a central part of patent practice here.
Pre-grant opposition: Under Section 25(1) of the Patents Act, 1970, any person can file a pre-grant opposition once an application is published and before the patent is granted. The Controller considers it alongside examination.
Post-grant opposition: Under Section 25(2), only a person interested can file a post-grant opposition, within one year of publication of the grant. The Controller refers it to an Opposition Board, which examines it and makes a recommendation before the Controller decides.
Grounds: Both routes rely on largely the same grounds, including lack of novelty or inventive step, non-patentable subject matter, insufficient disclosure and failure to disclose information about corresponding foreign applications.
Strategy for applicants: Careful drafting and complete disclosures at filing reduce the risk of a successful opposition, while monitoring published applications in your field lets you oppose competitors’ filings in time.
