A regional strategy has to deal with countries that use different filing systems.
Patents: Many Asian countries belong to the Patent Cooperation Treaty, which lets an applicant file one international application and enter national phases later. Others, such as Pakistan, Bangladesh and Nepal, are outside the PCT, so separate national applications must be filed, within 12 months of the first filing to claim Paris Convention priority.
Trademarks: The Madrid Protocol allows a single international trademark application to cover many member countries, including India. In countries outside the system, such as Bangladesh, Nepal, Sri Lanka and Myanmar, marks must be filed nationally.
Enforcement: Registration rules, evidence requirements and court practice differ widely across the region, so local associates who understand each system matter as much at the enforcement stage as at filing.
