IP in pharma and media: what makes India different
Pharmaceutical patents: Section 3(d) of the Patents Act, 1970 bars patents on new forms of known substances unless they show enhanced therapeutic efficacy. Section 107A, the Bolar exemption, lets generic makers use patented inventions to prepare regulatory submissions. Under Section 84, anyone can seek a compulsory licence three years after grant if the patented invention is not available to the public at a reasonably affordable price or is not worked in India; India granted its first in 2012.
Film and music copyright: Under the Copyright Act, 1957, the producer of a film is generally the first owner of copyright in it. Since the 2012 amendments, authors and composers of underlying works keep a right to royalties when those works are used outside the film, such as in broadcasts or public performance.
Fighting piracy: Indian courts grant John Doe orders against unknown infringers and dynamic injunctions that extend to mirror websites, which rights holders use to protect film and sports content around release dates and live events.
