About IP STARS
Managing IP, part of Legal Benchmarking Limited in London, published its first legal directory in 1994 and rebranded it as IP STARS in 2013. Its research covers several IP practice areas, including trade mark prosecution and trade mark disputes, across more than 70 jurisdictions.
Who qualifies: Private practice IP firms in each jurisdiction can take part by making submissions, and Managing IP also carries out its own research. There is no fee to participate.
How firms are chosen: Each edition follows a six-month research project in which Managing IP’s analysts gather information from firms, practitioners and clients through interviews, emails and surveys, and research court and IP office data.
The format: Firms are ranked in tiers within each practice area and jurisdiction, and individual practitioners are recognised separately, for example as Trademark Stars. No firm or individual can pay to be ranked or to influence the results.
What the ranking recognises
The ranking reflects the firm’s end-to-end trade mark practice:
Searches and filing: Clearance searches and filing and registration of traditional, non-traditional and certification marks before the Trade Marks Registry.
Portfolio management: Managing domestic and global trademark portfolios, with filing strategies that maximise protection while controlling cost, and timely renewals.
Oppositions and cancellations: Representing brand owners in opposition, rectification and cancellation proceedings.
Enforcement: Licensing and co-branding agreements, customs recordals, anti-counterfeiting action and takedowns on e-commerce platforms, for clients across food and beverages, FMCG, fashion, e-commerce, automotive, healthcare and many other sectors.
Keeping a trademark portfolio alive in India
Registration is only the start. A well-run portfolio depends on three rules that many brand owners overlook.
Renewal every ten years: A registered trademark lasts ten years from the date of application and can be renewed for further ten-year periods indefinitely. Renewal can be filed up to a year before expiry.
Grace and restoration: If the deadline is missed, the mark can still be renewed within six months after expiry on payment of a surcharge. Once removed from the register, it can be restored within one year of expiry, subject to the Registrar’s conditions. After that, protection is lost.
Use it or risk losing it: Under Section 47 of the Trade Marks Act, 1999, a registered mark can be removed if it has not been used for a continuous period of five years and three months up to the date of the application for removal. Keeping evidence of use in India protects the registration.
