Choosing classes and building a filing strategy in India
The decisions made when a trademark application is filed shape everything that follows, from what can be opposed to what can be enforced.
The Nice Classification; India follows the Nice Classification, with 45 classes: classes 1 to 34 for goods and classes 35 to 45 for services. Official fees are charged per class, so choosing classes carefully keeps costs in proportion to the protection needed.
Single or multi-class filing: A single application can cover several classes. This is efficient for a new brand, but an objection or opposition in one class can hold up the whole application, so some owners file separately for their most important classes.
Use or proposed use: An application can claim that the mark is already in use, giving the date of first use, or that it is proposed to be used. A prior-use claim must be backed by an affidavit and evidence, and an earlier use date can strengthen the owner’s position against later conflicting marks.
Describing goods and services: A specification that is too narrow leaves gaps; one that is too broad invites objections and challenges for non-use. Specifications should follow how the brand is actually used and where it is expected to grow.
