The statutes: IP in India is governed mainly by the Patents Act, 1970, the Trade Marks Act, 1999, the Copyright Act, 1957, the Designs Act, 2000 and the Geographical Indications of Goods (Registration and Protection) Act, 1999. Patents, designs, trademarks and geographical indications are administered by the Office of the Controller General of Patents, Designs and Trade Marks, and copyright by the Copyright Office.
The courts: IP suits are heard by district courts and High Courts, with high-value disputes handled under the Commercial Courts Act, 2015. Since the Intellectual Property Appellate Board was abolished in 2021, appeals from the IP offices also go to the High Courts.
Specialist IP Divisions: The High Court of Delhi set up a dedicated IP Division in 2021, with its own rules from 2022, and the High Court of Madras followed with an IP Division in 2023. These benches have built up deep experience in patent, trademark and copyright disputes.
