Interim injunctions and quick relief in Indian IP cases
In IP disputes, the first weeks often decide the outcome. Indian courts offer several routes to quick relief.
The interim injunction test: Courts generally ask three questions: whether the claimant has a prima facie case, whether the balance of convenience favours an injunction, and whether refusing it would cause irreparable harm that money could not put right. Delay in coming to court can count against the claimant.
Ex parte orders: Where giving notice would defeat the purpose, for example when counterfeit stock could be moved, courts can grant orders without hearing the other side first, often with local commissioners appointed to seize goods.
Summary judgment: For commercial disputes, Order XIII-A of the Code of Civil Procedure, introduced by the Commercial Courts Act, 2015, lets a court decide a case without a full trial where the defendant has no real prospect of success. Courts have used it to bring clear infringement cases to a quick end.
Costs and damages: Under the Commercial Courts Act, 2015, courts take a stricter approach to costs, and IP courts have increasingly awarded damages and costs to deter infringers.
