For businesses that need protection quickly, both the Patent Office and the Trade Marks Registry offer faster routes.
Patents: Under Rule 24C of the Patents Rules, 2003, an applicant can request expedited examination if it is a start-up, a small entity, a female applicant, a government department or institution, or an applicant that chose the Indian Patent Office as its international searching or examining authority under the PCT, among other categories. Expedited applications move to the front of the examination queue.
Trademarks: A trademark applicant can request expedited processing on payment of a higher official fee, which brings the application forward for examination. It is useful ahead of a launch, an investment round or enforcement action.
Choosing when to expedite: Faster examination brings forward objections and oppositions too, so it works best when the application is well prepared, clearance has been done, and the business genuinely needs early grant or registration.
