Trademark Opposition Procedure in Kazakhstan

Any individual or entity may formally oppose a trademark that has been published in the official trademark journal.

 The opposition process consists of the following key stages:

  1. Filing a Notice of Opposition
    A third party may submit a written opposition, supported by relevant evidence and arguments.
    This must be done within one month from the date of publication of the trademark.
    Note: This deadline is strict and cannot be extended.
  2. Applicant’s Response Upon receiving the opposition, the Kazakhstan Trademarks Office notifies the trademark applicant. The applicant is granted three months to respond by submitting counter-arguments and supporting documentation.
  3. Review and Decision After the applicant’s response is received, the Trademarks Office evaluates both parties’ submissions. A decision is then made in accordance with the provisions of Kazakhstan’s trademark legislation.
