Trademark Opposition Procedure in Kazakhstan
Any individual or entity may formally oppose a trademark that has been published in the official trademark journal.
The opposition process consists of the following key stages:
- Filing a Notice of Opposition
A third party may submit a written opposition, supported by relevant evidence and arguments.
This must be done within one month from the date of publication of the trademark.
Note: This deadline is strict and cannot be extended. - Applicant’s Response Upon receiving the opposition, the Kazakhstan Trademarks Office notifies the trademark applicant. The applicant is granted three months to respond by submitting counter-arguments and supporting documentation.
- Review and Decision After the applicant’s response is received, the Trademarks Office evaluates both parties’ submissions. A decision is then made in accordance with the provisions of Kazakhstan’s trademark legislation.
