Trademark Opposition Procedure in Nicaragua
Once a trademark application is published in the official journal by Nicaragua’s Intellectual Property Office, any interested party may initiate an opposition process.
- Filing a Notice of Opposition: The Opponent will have30 working days from publication, with the option to extend it once, for 15 additional working days to file the opposition along with evidence. The notice must clearly state the legal and factual grounds for opposition. The Opponent should also submit the supporting evidence or indicate intent to submit it. If evidence is not included initially, it must be presented within 15 calendar days from the date of filing the notice of opposition.
- Response from the Applicant: The applicant will be formally notified of the opposition. They will have 30 working days from the date of notification to submit a response. The Applicant should also submit the supporting evidence or indicate intent to submit it. If evidence is not included initially, it must be presented within 15 calendar days from the date of filing of the response to the notice of opposition.
- Decision by the Registry: After the response period ends, the Registry of Intellectual Property will examine the application and issue a resolution within 60 days by accepting or raising the objection against the said application.
- Appeal: the parties will have three days from the date of notification of resolution issued by the Registry, to file the appeal.
