Trademark Opposition Procedure in El Salvador

In El Salvador, any interested party may oppose a trademark application once it is published in the Official Trademark Bulletin. The opposition process is governed by the country’s trademark legislation and administered by the Registry of Intellectual Property (RIP).

Procedure for trademark opposition:

  1. Notice of Opposition:
  • An opposition must be filed within two months from the date of publication in the Official Trademark Bulletin.
  • No extensions are permitted for filing the opposition.
  • The notice must include the grounds for opposition and supporting evidence.

2. Review by Registrar & Counterstatement

  • The Registrar examines whether the opposition meets all legal requirements.
  • If accepted, an admission resolution is issued and the notice of opposition is formally served to the applicant.
  • The applicant then has two months to submit a counterstatement in response to the opposition.

3. Final Decision

  • After reviewing the opposition and the applicant’s response, the Registrar issues a final resolution.
  • This decision is based on the merits of the case, including the legal arguments and evidence presented.
  • The resolution is typically issued within one month following the applicant’s response.
