Trademark Opposition Procedure in Honduras

Any party may oppose a trademark application once it is published in the official journal La Gaceta by the Honduran Intellectual Property Office.

Procedure of Trademark Opposition:

  1. Publication & Opposition Window
    • After the application passes initial examination, the Industrial Property Registry Office publishes a notice in La Gaceta three times at ten-day intervals.
    • Interested parties may file an opposition during the publication period and up to 30 days after the last publication.
    • The opposition must clearly state the grounds and include or reference supporting evidence, following procedures outlined in the relevant Bylaws.
  2. Applicant’s Response
    • Once an opposition is filed, the Office notifies the applicant.
    • The applicant has 30 working days to submit a written response.
  3. Decision
    • The Office reviews the written submissions from both parties.
    • A decision is made based solely on the documentation provided—no formal hearings are conducted.
