Trademark Opposition Procedure in Honduras
Any party may oppose a trademark application once it is published in the official journal La Gaceta by the Honduran Intellectual Property Office.
Procedure of Trademark Opposition:
- Publication & Opposition Window
- After the application passes initial examination, the Industrial Property Registry Office publishes a notice in La Gaceta three times at ten-day intervals.
- Interested parties may file an opposition during the publication period and up to 30 days after the last publication.
- The opposition must clearly state the grounds and include or reference supporting evidence, following procedures outlined in the relevant Bylaws.
- Applicant’s Response
- Once an opposition is filed, the Office notifies the applicant.
- The applicant has 30 working days to submit a written response.
- Decision
- The Office reviews the written submissions from both parties.
- A decision is made based solely on the documentation provided—no formal hearings are conducted.
