Process of design registration:
Myanmar’s new Industrial Design Law was enacted on 30 January 2019 and comes into effect from 31 October 2023.
- The design application undergoes a formality examination
- Once accepted, the design application will proceed to registration.
- At the filing or priority date, the industrial design should be new in that, the industrial design was not disclosed to the public, anywhere in the world, by publication, use, or other disclosure.
Required Documents:
- Name, address and nationality of the Applicant.
- Name, address and nationality of the Designer(s).
- Clarification as to whether the design was made by the author in the course of employment with the Applicant, made in the execution of work which was commissioned by the Applicant or by virtue of an assignment.
- Name of the article(s) to which the industrial design is applied.
- Locarno classification of the article.
- A statement of novelty.
- Priority details (if claiming).
- Clear representations of the article(s), with a caption for each of the representations (e.g. perspective view, front view, back view, right view, left view, top view, bottom view).
- Original executed Form ID-2, signed by authorized representative of the applicant’s company and notarized by a Notary Public.
- Statement of Justifying the Applicant’s Right to Registration of Industrial Design.
- Certified Copy of Priority document as filed at the Convention country (if claiming). If the Priority document is not in the English Language, we will also require an English translation of the Priority document.
Time Frame:
- The design application undergoes a formality examination.
- Once accepted, the design application will proceed to registration.
- The application should be processed, examined and registered within 12-18 months from the filing date.
- The design registration is valid for 5 years from date of application.
- The design registration is renewable for two additional periods of 5 years, making a total of 15 years.
Multiple Designs:
Multiple design applications are allowed for designs which relate to the same Locarno class.
