Design Registration in South Africa
- Preparation and filing, including normal prosecution, registration of design and advertisement in Patent Journal;
- Examination, attending to official actions (if applicable) or additional correspondence;
- Acceptance, receiving and reporting certificate of registration.
Required Documents:
- Full name/s and physical address/es of the applicant/s;
- The “release date” of the design, if applicable. This is the date on which the design was first made available to the public anywhere in the world with the consent of the proprietor of the design or any predecessor in title;
- Particulars of the article/s to which the design is to be applied, and the features of the design for which protection is to be claimed;
- Representations in the form of drawings or photographs, with an indication of the particular view of each figure (e.g. front view, side view).
4.1 In the case of drawings – one clean copy of each drawing;
4.2 In the case of photographs;
– 6 prints of each photograph plus;
– 4 prints of the view for advertisement.
The photographs must be of a size to permit them to be mounted on A4 size paper with a clear margin of 40mm at the top, 25mm on the left hand side, 15mm on the right hand side and 40mm at the bottom.
- Declaration and Power of Attorney on Form D3 signed by the applicant.
- Certified copy of the basic foreign application if priority is claimed. If this document is in a language other than English, a certified English translation thereof is also required.
- An assignment of priority rights in a convention application where the applicant in South Africa is not the applicant in the basic foreign application.
No legalization is required
Time Frame:
The expected timeframe for a design to be registered is 1 year from the filing date.
Multiple Designs:
In South Africa, a separate design application must be filed for each article for which protection is required.
