Process of design registration:
Once the application is filed, the Examiner will conduct a search to verify the registrability of the industrial design application. The cost for responding to the examination report will be dependent on the time spent. Our industrial design attorneys’ hourly rates are USD80.00 and we will advise the charges for responding to search and examination reports (if any) once we have sight of the report(s) (if any). If there is no objection from the Examiner, the application will be registered. We will forward the certificate of registration upon receiving the same from MyIPO.
Required Documents:
1. Full name, address and nationality of each Applicant. If the Applicant is a partnership, the
full names and addresses of all the partners are to be given.
2. Full name, address and nationality of each author/creator of the design. If the author is not the Applicant, please advise how the Applicant derived the rights to the design from the authors, e.g. by way of assignment or contract of employment.
3. The particulars of the article (i.e., name of the article, classification, statement of novelty,
disclaimer (if any)) to which the design applies.
4. Description of the design.
5. Details of the priority application, specifically the convention country, filing date and application number. Please also forward a copy of the priority document. If the document is not in English, a certified/verified English translation is required.
6. Clear representations of the design providing views, i.e., front, back, top, bottom, sides (left, right) and perspective views. The representations must be clear and not contain details that do not form part of the industrial design.
7. ID Form 10 (Appointment of Agent). The signed form is required to be provided at the time of filing.
Time Frame:
The application should be processed, examined and registered within 12-18 months from the filing date.
Multiple Designs:
The industrial design application in Malaysia may be filed in respect of several design embodiments, provided they relate to the same class of the International Classification for Industrial Designs or to the same set or composition of articles.
