Process of design registration:
- Preparing a representation of the design
- Identifying the class of design.
- Providing a statement of novelty.
- Including a disclaimer that the design has not been in the public domain at any point in time.
- Claiming a priority date if the design Is registered in other countries.
- Determining the fee to be paid.
- Ensuring all enclosures are attached.
- Complying with objections if any.
- Providing full details pertaining to contacts and addresses.
- Formal examination: SENAPI will check whether the application meets the formal requirements. If the application is incomplete, you will be asked to provide additional information.
- Substantive examination:
- SENAPI will conduct an appraisal to see if your design meets the requirements for novelty, uniqueness, and industriality.
- SENAPI will compare your design with previously registered designs to ensure there are no duplicates.
- Publication: If your design is accepted, SENAPI will publish information about the registration in its gazette or database.
- Issuance of Certificate: After completing the procedures, SENAPI will issue you an industrial design registration certificate.
Required Documents:
- Power of Attorney, duly notarized- 60 days from filing.
- Certified copy of the priority document: 90 days from filing.
- Drawings. : Three graphic or photographic representations of the design, in color if necessary.
- Brief description of the design.
- Identification of applicant and designer.
- Locarno classification: NO. Local classification applies.
Time Frame:
- Average time from filing to grant: 1 year.
- Term of Protection and Maintenance is 5 years, counted from the filing date, plus 2 renewal terms of 5 years each.
Multiple Designs:
YES, the application may include up to ten diversified examples of the design, provided that the products correspond to the same class and there is similarity among all.
