Design Law in Oman

Process of design registration:

1. Designs applications in Oman can be filed along with the below documents or can be filed immediately without the same while the all the needed documents and/or fees to be submitted within two months as from the application filing date in Oman, in order to be accepted in terms of form.
2. Further, it is possible to file up to a maximum of one hundred (100) designs, provided they relate to the same class of the International Classification or to the same set or composition of articles.
3. The needed documents are filed in support of the application, the Registrar will start examining the application in terms of form and in case the application is compatible with all the formal conditions required as per the Omani Patent
4. The Omani Designs Office will forward the examination to the competent body which will examine the subject of the application and issue a rejection or acceptance decision with this regard, the application will be published in Omani official gazette
5. In case the application has been accepted it will be published in the Omani Office Gazette and will be subject to an opposition term for three months and in case no opposition has been filed, the design will be granted.
6. Please note that in order to renew design registrations, annuity fees shall be paid, noting that the design application is usually renewed twice only each five consecutive years.
7. The time frame for granting the Design Certificate may range between 12-14 months in smooth registrations.

Required Documents:

1. A Power of Attorney from the designer, duly legalized up to the Omani Consulate or (to be authenticated or certified by Apostille, if the applicant’s home country is a member of the Apostille Convention).
2. The title and drawings of the design, supported by brief description.
3. An copy Extract from the Commercial Register or Articles of Incorporation, or any equivalent document, duly legalized up to the Omani Consulate or (to be authenticated or certified by Apostille, if the applicant’s home country is a member of the Apostille Convention).
4. A certified copy of the priority document.
5. Filing Particulars of Applicants / Designers, their Addresses & Nationalities, title of design and classification.
6. Please note that legalized Power of Attorney and legalized Extract from the Commercial Register or Articles of Incorporation will be sufficient for filing any number of design applications for the same client in Oman.

Time Frame:

The time frame for examination range between 6-8 months.

The time frame for granting the Design Certificate may range between 12-14 months in smooth registrations.

Multiple Designs:

It is possible to file up to a maximum of one hundred (100) designs, provided they relate to the same class of the International Classification or to the same set or composition of articles.
