Design Law in Laos

Process of design registration:

  1. An industrial design application can be filed in either English or Lao. However, application documents submitted in English must be translated into Lao within 90 days from the application filing date. The translation must be certified to be a correct translation.
  2. An application for a design patent filed with DIP shall be subject to 2 phases of examination, i.e., formality examination and substantive examination.
  3. If the application is in conformity with the requirements for registering the industrial design as set forth in the Law on Intellectual Property and this Decision, DIP shall grant the design patent, document the related information in the register and database of DIP.

The design patent shall be published in the official gazette on the registration of industrial property, the incorrect information of which can be revised, free of charge, under the owner’s request within sixty (60) days form the first date of publication.

Required Documents:

  1. One original copy of Power of Attorney which is duly signed by your client (notarization and/or legalization is not required but wet-signature is compulsory);
  2. One original copy of Deed of Assignment of Right to File Application (notarization and/or legalization is not required but wet-signature is compulsory);
  3. One original copy of certified priority document and its English translation (if priority right is claimed);
  4. Drawings of design which showing front view, rear view, right view, left view, top view, bottom view, perspective view of the design. All are at the same scale, but the dimension of representation should not be less than 90mm x 120mm and not exceed 210mm x 297mm. Please note that the perspective view is always required. You can send the drawings to us via email for our preparation.

Time Frame:

In Laos, it takes approximately twelve (12) months from the date of filing to obtain a design patent in case of neither rejection nor opposition.

A registered design is valid for a period of fifteen (15) years from the date of filing the application.

Please note that multiple designs in a single application is possible in Laos.
