Design Law in Burundi

Process of design registration:

  1. Filing the application;
  2. Formal Examination: once the date of filing has been assigned, the Industrial Property Director shall examine whether the application meets the conditions in the regulations, and verify that the prescribed fee has been paid.
  3. Publication: in the event that the Industrial Property Director notes that the conditions have been met, he shall publish in the Official Journal of Burundi and on the Internet site of the Ministry responsible for trade a notice that he is prepared to register the industrial design;
  4. Publication of a reference to the registration;
  5. Issuance of the certificate of registration for the industrial design.

Required Documents:

  1. Request for application;
  2. Drawings, photographs or other appropriate graphic representations of the subject matter incorporating the industrial design;
  3. Indication of the type of products for which the industrial design is to be used.
  4. In the case of a two-dimensional drawing, the application for registration may be accompanied by a copy of the subject matter incorporating the design.
  5. Applicant data;
  6. Power of Attorney (simply signed);
  7. Assignment document (if applicable) with verified English translation;
  8. Copy of the Priority document (if applicable) certified, with verified English translation.

Time Frame:

The expected timeframe for a design to be registered is 3 to 6 months from the filing date.

Multiple Designs:

Two or more industrial designs may be the subject of the same application, provided they come under the same class in the international classification or refer to the same set or assortment of articles.
